Appeal from that part of an order of the Supreme Court (Kramer, J.), entered May 7, 1998 in Schenectady County, which partially denied plaintiffs motion for, inter alia, unpaid permanent maintenance and child support.

Plaintiff and defendant were married on July 21, 1956 and had three children, all of whom were over the age of 21 at the time of this action. On March 14, 1969, they entered into a *703written separation agreement which provided that defendant, an orthopedic surgeon, agreed to pay, inter alia, 30% of the net income earned from his medical practice for child support and…
