Appeal from an order of the Supreme Court (Hughes, J.H.O.), entered February 28, 2002 in Schoharie County, which, inter alia, denied plaintiffs motion to modify a judgment of divorce.

In a 1996 stipulation of settlement, which was incorporated but not merged in the parties’ judgment of divorce, defendant agreed to deed the marital residence and a 10-acre parcel of their jointly-owned real property to plaintiff, pay all expenses associated with maintaining the marital residence, divide the net proceeds from the sale of adjoining business property, and pay plaintiff maintenance of…
