The plaintiff: in error, hereinafter called defendant, was convicted of manslaughter in the first degree in the district court of Tulsa county and his punishment fixed at 25 years in the state penitentiary.
Briefly stated, the record discloses that prior to the homicide a state of ill will had arisen on the part of defendant against deceased Winans.
