BLISS, Judge:

Appellant, Richard Escobedo, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Comanche County, Case No. CRF-73-605, for the offense of Unlawful Delivery of Marihuana in violation of 63 O.S.1971, § 2-401, |f B-2. His punishment was fixed at a term of three (3) years’ imprisonment and a fine in the amount of Three Thousand ($3,000.00) Dollars was assessed. From this judgment and sentence, a timely appeal has been perfected to this Court.
