This is an original action in habeas corpus by petitioner Paul James Hart. Upon such petition a rule to show cause was issued, directed to the warden of the State Penitentiary, and a response and brief have been filed on behalf of the warden. Erom the pleadings and exhibits, the following facts appear :

On December 6, 1946, the petitioner was sentenced by the district court of Stephens county in ease No. 2654, to serve a term of two years in the penitentiary upon a plea of guilty to the charge of wife desertion, and such sentence was suspended during the good behavior of this petitioner. On…
