The plaintiff in error, hereinafter called defendant, was convicted of embezzlement in the district court of Cherokee county and was sentenced to serve a term of one year in the state penitentiary. Defendant was treasurer of the school district embracing the city of Tahlequah and outlying territory. The funds of the district were deposited in a Tahlequah bank. On April 3, 1928, defendant drew a check in the sum of $250 against the funds of the district, payable to the deposit bank.
