Kenneth M. Carpenter, Esq., appeals the decision of the United States Court of Appeals for Veterans Claims (“the Veterans Court”), dismissing his appeal of the denial of attorney fees in accordance with his fee agreement with veteran Dwight D. Bowyer.1 We conclude that the Veterans Court incorrectly interpreted 38 U.S.C. § 5904(c). On the correct interpretation, the fee agreement applies in accordance with its terms.
