The petitioner, through counsel, has filed a petition for a writ of mandamus to compel the Secretary to provide expeditious treatment, pursuant to section 302 of the Veterans’ Benefits Improvements Act, Pub.L. No. 103-446, § 302, 108 Stat. 4645, 4658 (1994) (found at 38 U.S.C. § 5101 note) (VBIA § 302), of his appeal contesting the effective date assigned by a Department of Veterans Affairs (VA) regional office (RO) for an award of VA non-service-connected pension.
