This is an appeal by the plaintiff from a judgment for defendants in an action to recover under a contract in writing to pay a real estate broker’s commission.

Trial was before the court without a jury. The court entered findings of fact which in part are to the following effect: Plaintiff, Donald H. F. Miller, was a duly licensed real estate broker with an office and principal place of business at Medford, Oregon, and one L. E. Gilliam was a duly licensed real estate salesman under the plaintiff.
