1Opinion of the Court
Appellant brought suit in the ordinary form of trespass to try title, to recover of appellee 174 1/2 acres of the Jesse Williams survey. Appellee pleaded not guilty, the statute of limitations, and impleaded his warrantor, M. W. Rogers. There was a trial before a jury which resulted in a verdict and judgment for the defendants.
Appellee insists that the judgment herein should be affirmed without reference to the assignments of error filed by appellant, for the reason that appellant showed no title to the land in controversy. In this we concur. Appellant being plaintiff, it was incumbent upon…
