DAUGHERTY, Chief Judge.
ORDER
Plaintiffs bring this action alleging that they have sustained damages as a result of the Defendants having caused water to be diverted across the Plaintiffs’ lands. Plaintiffs seek as relief herein a judgment against the Defendants for actual and punitive damages. It is asserted that this Court has jurisdiction of the actibn pursuant to 28 U.S.C. § 1332 by reason of diversity of citizenship and amount in controversy.
