MEMORANDUM OPINION
RICHARD J. LEON, District Judge.
T.M., a disabled minor, and his foster and surrogate parents (“parents”), 1 bring this suit against the District of Columbia (“defendant” or “the District”), alleging that District of Columbia Public Schools (“DCPS”) deprived T.M. of the right to a free appropriate public education (“PAPE”) in violation of the Individuals with Disabilities Education Act, as amended by the Individuals with Disabilities Education Improvement Act of 2004 (collectively, “IDEA”), 20 U.S.C. § 1400 et seq., and the Rehabilitation Act § 504, 29 U.S.C. § 794.
