—Judgment unanimously reversed on the facts and indictment dismissed. Memorandum: Defendant was convicted following a jury trial of bail jumping in the first degree (Penal Law § 215.57) as a result of his failure to appear on August 31, 1998, the last day of trial on another charge. Defendant had been given Parker warnings (see, People v Parker, 57 NY2d 136) and was convicted and sentenced in absentia (see, People v Vigliotti, 270 AD2d 904, lv denied 95 NY2d 839).
