Appeal from an order of the Court of Claims (Nicholas V Midey, Jr., J.), entered July 7, 2004. The order granted defendant’s motion to dismiss the claim pursuant to CPLR 3211.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.
