RUDKIN, Circuit Judge.

August 8, 1926, there was in force and effect a contract of insurance between the Indemnity Insurance Company o£ North America, as insurer, and one Mary C. Kittredge, as assured, by the terms of which the company agreed to indemnify the assured, in an amount not exceeding $10,000, against claims for damages for bodily injuries or death alleged to have resulted from the operation of an automobile owned by the assured and described in the policy.
