OPINION
OMAN, Judge.
On January 15, 1958, defendant pleaded guilty to armed robbery committed on January 2, 1958. He was sentenced to confinement in the New Mexico State Penitentiary for a term of not less than three nor more than twenty-five years.
The case is now before us on appeal from an order denying without hearing his motion filed pursuant to Rule 93 [§ 21 — 1— 1(93), N.M.S.A.1953 (Supp.1967)]. He seeks to have his judgment of conviction and sentence to the penitentiary, entered upon his plea of guilty, set aside on the claimed grounds:(1) That he was arrested on the morning of January…
