OPINION & ORDER
HERLONG, District Judge.
This matter is before' the court on two motions for summary judgment. The first was filed by Ronald Gedda (“Gedda”) (hereinafter “Gedda’s Motion”), and the second was filed by Greenville Hotel Partners, Inc. (“GHP”), R.G. Hospitality, LLC, (“RGH”), and Gedda (hereinafter “RGH/Gedda’s Motion”). 1 For the reasons stated below, the court denies Gedda’s Mo tion and grants RGH/Gedda’s Motion in part and denies it in part.
