The court, on refusing judgment upon the verdict, dictated the following record entry: “On the coming in of the verdict, the jury having answered the issues as shown in the record, and the court being of opinion that the plaintiff is not entitled to recover, refuses to sign judgment tendered by the plaintiff, as shown by the record, as a proposition of law, to which ruling the plaintiff excepts and gives notice of appeal to the Supreme Court.”

There were other assignments of error by the plaintiff as to the admission of evidence and as t'o the refusal of prayers to charge, but as the verdict…
