The defendant filed on October 17, 1932, in said cause the following motion, to wit:

“Comes the defendant and appearing specially for the purpose of this motion, and for no other purpose, represents unto the Court as follows:
“Heretofore, on, to-wit, the 7th day of September, 1932, this same plaintiff in this case, filed a suit against this same defendant on this same cause of action in the Jefferson County Court of Common Claims, at Birmingham, Jefferson County, Alabama being a court of competent jurisdiction, and said case in said Jefferson County Court of Common Claims came up…
