SCHROEDER, Justice.
This is an appeal by Rosebud Enterprises, Inc. (Rosebud) from those portions of Idaho Public Utilities Commission (IPUC) Orders No. 25870 and 25922 which approved Pacifi-Corp’s proposed adjustments to the base avoided cost rate for the purchase of electric capacity and energy from Rosebud’s pro posed electric generating facility. Rosebud also requests an award of attorney fees, witness fees, expenses and costs pursuant to section 12-117 of the Idaho Code and Idaho Appellate Rule 40.
