The plaintiff, as incident to an application to the liquor control commission for the removal of a restaurant all-liquor permit to certain premises in Berlin, applied to the defendant as town clerk of that town to certify that the sale of liquor at the new location described therein was permissible under the zoning-regulations, and upon his refusal brought this mandamus proceeding to compel him to issue the certificate.
