Affirming.

On February 8, 1943, the Commonwealth, acting-through its then attorney general, the Hon. Hubert Meredith, attacked in the Franklin Circuit Court the constitutionality of the Act of the 1942 General Assembly (KRS 64.350) requiring payment to the Fiscal Courts-of Counties having a population of 75,000 or more of 25% of the official fees collected therein and paid into the-State Treasury in accordance with Section 106 of the Constitution.
