The petitioner sues out the writ of habeas corpus, claiming to be illegally deprived of his liberty by the sheriff of Kings county. That officer makes return to the writ that he holds- him under a commitment of Henry F. Haggerty, Esq., a police justice of the city of Brooklyn. The commitment recites that the petitioner is held under an order of commitment to answer a charge of murder in the first degree, made by the said magistrate after examination.
