The Public Utilities Commission of the Territory of Hawaii sought an injunction to restrain the respondentsappellees from operating as a common carrier of passengers upon the public highways within the City and County of Honolulu without first obtaining a certificate of public *399convenience and necessity as required by chapter 82 of the Revised Laws of Hawaii 1945, as amended.
