The plaintiff in error (hereinafter designated the defendant) entered into a contract with the defendant in error (hereinafter designated the plaintiff) for the construction of a street railway at Shawnee, Okl. T. The stipulated amount of the cost of the work was $74,800. There was to be paid in cash $34,800.
