The Foster Lumber Company commenced this action against union school district No. 1, Kay county, to recover tho sum of $190.60 on an account. The account was for furnishing lumber and certain material to1 the school district to make certain repairs on the schoolhouse therein. The account was created by a contract entered into between the school board, or a majority thereof, and the plaintiff, the Foster Lumber Company.
