This is an action of tort to recover for personal injuries sustained on April 27, 1941, when the plaintiff, a pedestrian on a public way in Springfield, was struck by an automobile owned and operated by the defendant, a resident of Chicopee and a member of the United States Army on furlough. From the date of the accident until his discharge on September 8, 1941, the defendant was stationed at Camp Edwards in this Commonwealth.
