As the jurors were about to be empaneled for the trial of this complaint, the defendant filed a chair lenge to the array. Issue of law was joined thereon. Commonwealth v. Walsh, 124 Mass. 32, 35. Provident Institution for Savings v. Burnham, 128 Mass. 458, 461. The ground on which that challenge rests is that there were no women on the lists from which the jurors were drawn.
