In December 1997, the Equal Employment Opportunity Commission (“EEOC”) received charges of age discrimination from two employees of the North Gibson School Corporation (“NGSC”). The charges alleged that NGSC’s early retirement plan (“ERP”) discriminated on the basis of age in violation of the Age Discrimination in Employment Act, as amended, 29 U.S.C. § 621 et seq. (“ADEA”).
