delivered the opinion of Commission of Appeals.

This suit was filed in the District Court of Harris County, Texas, by Palmetto Lumber Company et al. against J. P. Gibbs et al., holders of the estate of Sallie E. Gibbs, deceased. We interpret the petition as an action for an accounting, and to recover the title and possession of 6493.05 acres of land in Jasper and Newton Counties, Texas. The record in this case is one of the largest ever filed in this Court. The trial in the district court was by the Court without a jury, and resulted in a judgment denying the Palmetto Lumber…
