This matter is before the Court on defendant’s motion for summary judgment. In 1996, plaintiffs filed separate law suits in the Circuit Court for the City of Hampton, Virginia, against defendant and ten John Does (unidentified deputies). In January, 2000, the state court dismissed plaintiffs’ claims against the ten John Does, leaving only the defendant in both cases.
