Plaintiff, C. D. Bourne d/b/a Sheet Metal Products Company, brought action against the defendant, State Highway Commission of Wyoming, to recover for material and services furnished in the repair of a roof on the office building owned and occupied by the defendant. The defendant, on the day preceding the filing of its answer, filed a third-party complaint against Spiegelberg Lumber and Building Company, a contractor; against Sam C.
