OPINION

ADELE HEDGES, Chief Justice.

On June 17, 2008, we declined to issue mandamus relief compelling the respondent 1 to extend a contractual jury waiver to a nonsignatory. Relators now urge us to extend the jury waiver to the nonsigna-tory on the basis of agency principles, an argument not before us in the earlier mandamus proceeding. We hold that a valid contractual jury waiver may be invoked by the agents of a signatory party. However, we decline to extend a jury waiver to a nonsignatory that is merely alleged to be the signatory’s agent. Therefore, we deny the petition for writ of…
