Jackson brought his action against the Chattanooga, Rome and Carrollton Railroad Company, for damages sustained by him by reason of personal injuries inflicted upon him. by the negligence of the company. This action was brought to the February term, 1889, of Walker superior court. At that term the defendant filed a plea in abatement, alleging, in substance, that the plaintiff should not have and maintain this action, because on the 18th of January, 1889, he began his action against the defendant in a justice’s court in the State of Tennessee, for $200, for injuries to a minor…
