VAUGHT, District Judge.

In this action, hearing was had upon the motion of the defendant to dismiss complainant’s bill. The bill alleges that the complainant is a Delaware corporation, licensed to do business in Oklahoma; that the city of Oklahoma City is a municipal corporation; that the amount in controversy exceeds $3,000; that on the 15th of October, 1929, and for a long time prior thereto, one W.
