Affiliated Capital Corporation and ACRG Joint Venture, appellants, (hereinafter collectively “the Venture”), bring this appeal from a summary judgment in favor of Commercial Federal Bank and Ryan Mortgage Company, appellees (hereinafter referred to collectively as “the Bank”). After a dispute arose over a loan transaction, the Venture sued the Bank on claims of usury, breach of contract, breach of a duty of good faith, violation of the Deceptive Trade Practices-Consumer Protection Act (DTPA), 1 and unfair collection tactics.
