I. INTRODUCTION

Plaintiff Travelers Casualty and Surety Company of America (“plaintiff’) brought this common law negligence action against defendant Bancorp Bank (“defendant”) on April 7, 2009. (D.I. 1) Plaintiff is the fidelity insurer of The Benefit Consultants Group, Inc. (“Benefit”).
