MEMORANDUM OPINION AND ORDER

ELMO B. HUNTER, Senior District Judge.

Before the Court is defendant’s motion to transfer. The Court held a hearing on the motion at which counsel for both sides presented oral arguments, though no formal testimony was offered. Since the hearing, affidavits of the plaintiffs have been filed with the Court.

This is a diversity action based upon franchise agreements which plaintiffs entered into with defendant. Plaintiffs are suing defendant for fraud and, alternatively, for breach of contract. In reliance upon a forum selection clause found in the franchise agreement,…
