FINDINGS, CONCLUSIONS AND ORDER

JOHNSON, Chief Judge.

The plaintiffs in these consolidated cases are either persons who were injured or the administrators of the estates of persons killed on February 21, 1970, in a low-rent public housing project owned by the Housing Authority of the town of New Brockton, Alabama. The plaintiffs are claiming, pursuant to the Federal Tort Claims Act, 28 U.S.C. A. § 2680 et seq., liability and damages of the United States for alleged acts and omissions during the construction phase of the project.1 The eases are now submitted upon the pleadings, the evidence…
