DECISION DENYING DEFENDANT CITIMORTGAGE, INC.’S MOTION TO DISMISS

The court has jurisdiction over this matter pursuant to 28 U.S.C. §§ 157(a) and 1334, and the standing General Order of Reference in this District. This matter is before the court on Defendant CitiMort-gage, Inc.’s Motion to Dismiss the Plaintiffs Amended Complaint [Adv. Docs. 10 and 33] 1 ; the Plaintiff-Debtor Thomas N.
