MEMORANDUM OPINION AND ORDER
LOZANO, District Judge.
The Plaintiff, the United States (“United States”) brought this action against Bethlehem Steel Corporation (“Bethlehem”) alleg ing that Bethlehem violated the Resource Conservation and Recovery Act (“RCRA”), 42 U.S.C. § 6901, et seq., and the Safe Drinking Water Act (“SDWA”), 42 U.S.C. § 300f, et seq.
