This action includes causes of action under the Comprehensive Environmental Response, Compensation and Liability Act (“CERCLA”), 42 U.S.C. § 9601 et seq., and other theories, arising from the presence of wastes at a site in Oak Creek, Wisconsin (“Oak Creek Facility”). Before the court is the motion to amend the complaint of plaintiffs A-C Reorganization Trust (“A-C Trust”) and The Edison M. Boerke Trust (“Boerke Trust”) (collectively, “Plaintiffs”).
