Appeal from District Court, Walsh County; Templeton, J. Action by M. S. Hostetter against the Brooks Elevator Company. There was a judgment for plaintiff, and defendant appeals.

This action is to recover the value of certain wheat. The plaintiff claims a special property in the wheat, under a chattel mortgage. The salient facts are as follows: On the 16th day of January, 1890, one William Rogers was the owner of a certain quarter section of land in Pembina County, and on that day executed and delivered to M. S. Hostetter & Son his promissory note for the sum of $410.50 and interest at 12 per cent, per annum, and to -secure the note, executed and delivered on said day a chattel mortgage in the usual form, whereby he mortgaged to said M.
