THIS MATTER is before the Court on Defendant’s Motion to Dismiss for lack of subject matter jurisdiction pursuant to Fed.R.CivJP. 12(b)(1). (Doe. No. 20). The Court held an evidentiary hearing on January 19, 2011, to consider whether Plaintiff has standing to bring an Americans with Disabilities Act claim against Defendant. After considering the parties’ arguments at the hearing, their briefs and supporting documentation and evidence, and the applicable law, Defendant’s Motion to Dismiss is GRANTED.
