MEMORANDUM OPINION AND ORDER
THOMAS D. SCHROEDER, District Judge.
Plaintiffs National Alliance for Accessibility, Inc. (“NAA”), and Denise Payne (“Payne”) seek declaratory and injunctive relief against Defendant Chapel Hill North Properties, LLC (“CHNP”) for alleged violations of the Americans with Disabilities Act of 1990, 42 U.S.C. §§ 12101-12213 (2006 & Supp.2011) (“ADA”). Before the court is CHNP’s motion to dismiss the complaint for lack of subject matter jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(1). (Doc. 8.) For the rea*570sons set forth below, the motion will be granted.
