In an action to recover damages for medical malpractice, and for wrongful death, etc., the plaintiff appeals from an order of the Supreme Court, Nassau County (Molloy, J.), dated February 13, 1990, which denied his motion to dismiss the defendants’ fifth and sixth affirmative defenses and granted the defendants’ cross motion to dismiss the complaint.
Ordered that the order is affirmed, with costs.
