The defendant demurred generally and specially to the petition. ' The general demurrer to the first count was as follows: “ (1) No cause of action is set forth in said petition against this defendant. (2) No judgment for specific performance, as against this defendant, can be had under the allegations of said petition. (3) No property of any kind or character is shown to be in the custody or control of this defendant, nor is Mary Gazalene Lamar Ellis shown, at her death, to own or possess any property of any kind or character, about or upon which a judgment…
