Plaintiff entered into an oral course-of-construction insurance binder 1 with Country Mutual Insurance Company (defendant) through its agent, Ronald Pittman. Before receiving the written policy, plaintiffs partially built home was damaged by inclement weather. After defendant denied plaintiffs insurance claim, citing exclusions in the written policy, plaintiff filed an action against defendant. At trial, defendant moved for a directed verdict on plaintiff s breach of contract claim. The trial court denied defendant’s motion and a jury found for plaintiff.
