The plaintiff, a corporation, sued the defendant for the price of goods, wares and merchandise sold and delivered to him, with interest thereon from a date specified. The summons, with a certified copy of the complaint, was served upon the *635defendant in the county in which the action was commenced, on the 14th of June, 1866. On the 22d of that month the defendant appeared by attorney and demanded of the plaintiff’s attorney a copy of the account on which the action was brought, and on the day following procured from the Judge of the Court an order granting him ten…
