This was a bill in equity filed by appellants, who are owners of dwellings fronting on the west side of Ninth Street, south of Fisher Avenue, in the City of Philadelphia, and whose properties abut on a 12-feet wide private driveway in the rear of their lots, of which they were granted in their deeds the free and common use, “in common with the owners, tenants and occupiers of the premises abutting thereon and entitled to the use thereof,” to restrain the defendants who are the owners of land fronting on the east side of Hutchinson Street, the rear of whose lots abut on…
